Por Resolución de la Dirección General de Industria, Energía y minas de fecha 10 de febrero de 2010, ha sido declarada la urgente ocupación de los terrenos afectados por la expropiación forzosa, para la instalación de la línea eléctrica de 220 kV, doble circuito, entre la subestación Lebrija y la subestación Puerto de Santa María, en las provincias de Sevilla y Cádiz, promovida por la mercantil Valoriza Energía, Sociedad Limitada Unipersonal.
Peticionario: Valoriza Energía, S.L.U., (CIF B-82806951), con domicilio a efectos de notificaciones en Avda. Astronomía, s/n, Manzana 5, Torre 2, 7ª planta, módulo 14 (Parque empresarial nuevo Torneo), Sevilla.
Finalidad de la instalación: Evacuación de la energía eléctrica generada en la plantas solares térmicas "Lebrija I", "Lebrija II" y "Lebrija III"
Características técnicas de la línea eléctrica:
- Origen: S.E.T. Lebrija.
- Final: S.E.T. Puerto de Santa María.
- Términos municipales afectados: Lebrija (Sevilla), Trebujena, Sanlúcar de Barrameda y Puerto de Santa María (Cádiz).
- Tipo: Aérea.
- Frecuencia: 50 Hz.
- Tensión de servicio: 220 kV.
- Tensión más elevada de la red: 245 kV.
- Potencia máxima a transportar por circuito: 540 MVA.
- Circuitos: 1 (a futuro 2).
- Nº de conductores por fase: 2.
- Nº de cables de tierra: 1 (a futuro 2).
- Longitud en metros: 49.568 metros.
- Longitud del tramo Sevilla: Lebrija (19.035 m).
- Longitud del tramo Cádiz: Trebujena (7.730 m), Sanlúcar de Barrameda (18.337 m), y Puerto de Santa María (4.466 m).
- Disposición: Bandera (a futuro hexagonal).
En su virtud, y en cumplimiento de lo dispuesto en el art. 52 de la Ley de Expropiación Forzosa de 16 de diciembre de 1954 (en adelante L.E.F.) se publica que el levantamiento de las actas previas a la ocupación tendrá lugar los días día 9, 10 y 12 de noviembre de 2010 en el Ayuntamiento de Lerbija.
La relación de titulares convocados, así como la hora, día y lugar en que se les convoca, se establece como Anexo al final de este anuncio.
Se notificará individualmente a cada interesado el día, hora y lugar en que se le convoca para el levantamiento del acta previa a la ocupación, al objeto establecido en el apartado 3º del art. 52 de la L.E.F. Los propietarios y demás interesados, titulares de cualquier clase de derechos e intereses sobre los bienes afectados, podrán acudir personalmente o representados por persona debidamente autorizada, aportando los documentos acreditativos de su titularidad. Asimismo, previamente al levantamiento del Acta Previa a la ocupación, podrán formular por escrito, ante esta Delegación Provincial, alegaciones para subsanar posibles errores al relacionar los bienes afectados (art. 56.2 del Decreto de 16 de abril de 1957, por el que se aprueba el Reglamento de la L.E.F.).
En base al mencionado artículo 52 de la L.E.F., abonados o consignados el depósito previo a la ocupación y la previa indemnización por perjuicios, la Administración procederá a la inmediata ocupación del bien, tras la cual se tramitará el justiprecio y pago.
Es de significar que esta publicación se realiza, igualmente, a los efectos que determina el art. 59.5 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común.
